Trust and Estate Contests

The executor (personal representative) of an estate or trustee of a trust owes the beneficiaries a fiduciary duty—the responsibility for being fair and honest in administering the assets involved. If the executor or trustee makes improper investments, unfairly administers assets to benefit himself or herself, fraudulently transfers real estate, or if the administrator receives excessive compensation—heirs and beneficiaries can apply to the court for relief, charging breach of fiduciary duty.

Estate Planning

Our comprehensive estate planning services include creating or amending:

  • Wills, Codicils, and Trusts

  • Advance medical directives (living wills and health care powers of attorney)

  • Financial powers of attorney

We take the time to understand our client's needs so that we can create an estate plan that is affordable and makes the most sense for each individual client.

Probate Litigation

Financial exploitation and fraud occur when a person uses his or her influence and power over another to force or coerce the person to change their Will, deed them an interest in a house or land, or create a power of attorney that the perpetrator then uses to steal from an unsuspecting victim.

We help individuals stop the fraud, recover the stolen money or property and hold perpetrators responsible for their illegal and immoral behavior.

Nursing Home Abuse and Neglect

Unspeakable acts occur within our nursing homes, hospitals and assisted-living facilities throughout the country.  Such horrific acts include:

  • Physical and sexual abuse by staff or other residents

  • Improperly administered medications resulting in injury or death

  • Improper care and supervision resulting in bed sores, falls or elopement from the facility

If you have a loved one who is injured or dies in a care facility please contact our office without delay.

As we grow older our needs change.  Accidents, medical conditions, or the natural process of aging brings challenges to many of us and our families.  As such, it is important to have a comprehensive plan in place should the day come when we can no longer care for ourselves or our loved ones.  The unfortunate reality is that many of us don't plan for the possibility that we may one day become physically or cognitively impaired.  If this happens, our children, spouses, nieces or nephews, or other caring individuals are left to figure out how best to care for us.

We specialize in working with families of those who have a loved one with an incapacitating condition, whether the condition gradually progressed over a period of time or suddenly occurred as a result of a medical event.  We help families understand their options and assist them with putting the necessary protections in place to keep their loved one safe.

We also recognize the disturbing fact that there are those who seek to take advantage of vulnerable adults by committing unspeakable acts of abuse, neglect and financial exploitation.  Whether the culprit is a family member, financial advisor, care provider or other trusted individual we will work with you to hold the perpetrator accountable and recover stolen or misappropriated money.
